INTRODUCTION

Welcome to Showtime Flag ("we," "us," or "our"), where our mission is to provide engaging, safe, and competitive sports experiences for our participants. We value the role that sports play in promoting physical health, team spirit, and personal growth. With a variety of programs designed for different age groups and skill levels, we are committed to fostering a dynamic and inclusive environment where young athletes can thrive.

As you entrust us with this opportunity to be a part of your child's athletic journey, we pledge our unwavering commitment to upholding the highest standards of our programs. We encourage you to familiarize yourself with the following terms and be assured that, at Showtime, we are more than a sports program—we are a community dedicated to nurturing the next generation of athletes.

1. RISK ACKNOWLEDGEMENT AND LIABILITY WAIVER

Acknowledgment of Risk. As a parent or guardian, I acknowledge that participation in Showtime Flag LLC's flag football programs, events, and activities involves physical exercise and potential for incidental contact that is inherent in any sport. While Showtime Flag LLC takes reasonable steps to provide a safe environment, I recognize that the risks to my child include minor injuries such as scratches, bruises, and strains. Although serious and catastrophic injuries are rare in flag football, I understand they can occur and might include serious musculoskeletal injuries, concussion, or other less common sports-related injuries. I accept these risks as part of my child's participation in Showtime Flag LLC's programs.

Waiver and Release. I, as the parent or legal guardian of the participating minor(s), on behalf of myself, my family, my heirs, and my child, release Showtime Flag LLC and its representatives from any liability for injury, death, or property damage that might arise from my child's participation in these activities.

Indemnification. I agree to indemnify and hold harmless Showtime Flag LLC and all associated parties from any liabilities, claims, or expenses, including legal fees, that arise from my child's involvement in these programs.

Medical Acknowledgment and Health Affirmation. I am fully aware of and understand the potential risks involved in the activities offered by Showtime Flag LLC. By allowing my child to participate, I affirm that my child is in good health and physical condition, has no underlying medical conditions, allergies, or physical disabilities that would restrict or prohibit participation in these activities. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that my child may sustain as a result of participating in any of the activities.

Parent/Guardian Consent. As the parent or legal guardian with responsibility for the minor participant(s), I provide my consent for their participation as detailed in this agreement. I release and agree to indemnify Showtime Flag LLC from any liabilities arising from my minor child's involvement in the programs as provided above.

Acceptance of Terms. By completing the registration for Showtime Flag LLC's programs, I affirm that I have fully reviewed, understood, and agreed to all the terms within this Risk Acknowledgement and Liability Waiver. I recognize that by consenting to this waiver, I am waiving certain legal rights on behalf of my minor child(ren), including the right to sue.

2. ELIGIBILITY CRITERIA

Parental Consent. For activities in which children under the age of 18 are allowed to participate, such as in leagues, camps, or tournaments, we require the consent and involvement of a parent or legal guardian. All registration data and other requested personal data for such activities must be provided by the parent or legal guardian.

Health and Fitness. All participants are expected to be in good health and physical condition to engage safely in the activities and programs we offer. By registering for our programs, you acknowledge that you are aware of the physical demands involved and confirm that you, or your minor child, are fit to participate.

Skill Level. Our programs are open to players of varying skill levels, from beginners to more experienced athletes. However, we recommend that participants have some previous playing experience in the sport. This ensures not only a more competitive environment but also a safer one, as players with some degree of experience are generally more aware of the rules and physical demands of the game.

Good Standing Requirement. To participate in our programs, all participants must be in good standing. This includes not being currently suspended or previously expelled from any of our programs and being up-to-date on all financial obligations, such as dues and fees. Failure to meet these good standing criteria may result in disqualification from current enrollment and may affect eligibility for future participation in our programs.

AGE CRITERIA

Spring 2024. The age cutoff for each division is January 1, 2024.

  • 9u Division: Must be 9 years of age or younger on December 31, 2023.
  • 11u Division: Must be 11 years of age or younger on December 31, 2023.
  • 13u Division: Must be 13 years of age or younger on December 31, 2023.

Fall 2024. The age cutoff for each division is August 1, 2024.

  • 8u Division: Must be 8 years of age or younger on July 31, 2024.
  • 10u Division: Must be 10 years of age or younger on July 31, 2024.
  • 12u Division: Must be 12 years of age or younger on July 31, 2024.
  • 14u Division: Must be 14 years of age or younger on July 31, 2024.
  • 16u Division: Must be 16 years of age or younger on July 31, 2024.

Age Verification. Parents must provide documentation to verify their child's age by registering for online player sport IDs, which will request the necessary documents.

3. PHOTO AND VIDEO RELEASE

By participating in our programs, participants and, for minors, their parents or legal guardians, grant permission for us to take and use photographs and video recordings of program activities for promotional, educational, or informational purposes without compensation.

Usage of Media. Consent is granted for us to utilize these photographic or video recordings in a variety of publications and materials, including but not limited to:

  • Marketing brochures and flyers
  • Advertisements
  • Websites and social media content
  • Press releases and media submissions
  • Educational materials and presentations

Protection of Participant Identity. While we reserve the right to publish and broadcast these images and recordings, no participant will be personally identified by full name or other personal identifying details in any promotional or educational materials without obtaining additional, explicit consent.

Opt-Out Provision. We respect the privacy concerns of our participants. Those who do not wish to have their image or video recordings utilized for these purposes are asked to provide written notification to us at privacy@showtimeflag.com prior to the commencement of the program. We will endeavor to honor such requests and exclude the individual from media capture to the best of our ability.

Ownership of Media Content. All photographic and video recordings taken by us or its representatives during the program are the exclusive property of Showtime Flag LLC and may be used by us in accordance with the permissions granted above.

4. REFUND POLICY

Our programs are carefully planned and scheduled, therefore we have a strict no-refund policy. We encourage participants to review all program details and their personal schedules before registration to ensure program participation.

EXCEPTIONS TO POLICY

Program Cancellation Before Start. If we cancel a program before it has begun, registered participants will receive a full refund. This full refund is applicable only when the cancellation is initiated by us due to reasons such as insufficient enrollment or other operational reasons determined by us.

Program Cancellation After Start. If we cancel a program after it has already started, registered participants will receive a prorated refund. This refund will reflect the proportion of the program that has not been completed at the time of cancellation.

Calculation of Prorated Refund. The prorated refund will be calculated by dividing the number of program days or sessions remaining at the time of cancellation by the total number of days or sessions that were scheduled. This ratio will then be applied to the total program cost to determine the amount to be refunded.

No Refunds for Other Circumstances. Please note that there are no refunds for participant absences, dismissals, or program disruptions due to inclement weather or other unforeseen circumstances. Our no-refund policy stands firm in these situations.

Processing of Refunds. Refunds will be processed to the original payment method used during registration. We ask for your patience as the refund process can take some time due to standard processing times required by banking institutions and credit card companies.

5. CREDIT POLICY

We understand that unforeseen medical issues can arise after registration that may prevent participation in the program. In such cases, we offer a credit policy.

Medical Credit. If a participant is unable to attend the program due to medical reasons that arose after the time of registration, we will issue a credit to their account. This credit is applicable for future programs and activities offered by our organization.

Documentation. To be eligible for a medical credit, participants must provide a medical certificate or a letter from a licensed healthcare provider confirming that they are unable to participate in the program due to medical reasons.

Notification. Participants must notify us in writing of their need to withdraw due to medical reasons as soon as possible. The request for a program credit due to medical reasons must be received within one week from the doctor's visit.

Credit Value. The credit will reflect the prorated value of the program registration fee and must be used within one calendar year from the date of issue.

Non-Transferable. Credits are non-transferable and may only be used by the individual who was originally registered for the program.

Extenuating Circumstances. In the event of severe or extenuating circumstances, the decision to issue a credit will be made at the discretion of our administration. We reserve the right to request additional documentation as deemed necessary.

No Show Policy. Participants who do not show up for the program without prior notification as outlined above will not be eligible for credits.

Credit Processing Time. Please allow up to two weeks for the processing of credits after we have received the written request and accompanying documentation.

6. PROGRAM CHANGES

We are committed to delivering high-quality programs and experiences. However, there may be occasions when changes to program details are necessary due to various factors. These factors may include, but are not limited to, venue availability, staffing adjustments, or scheduling conflicts.

Changes to Program Details. We reserve the right to make changes to program details such as schedules, locations, and coaching or instructional staff as needed. We understand that any change can impact our participants, and we strive to keep such changes to a minimum.

Communication of Changes. In the event of a program change, we will notify all affected participants as quickly as possible.

Notifications will be communicated through the following channels:

  • Email. A detailed message explaining the nature of the change and any necessary actions participants need to take will be sent to the email address provided at registration.
  • Phone. If a change occurs with insufficient time to reasonably expect an email to be seen, we may follow up with a text or phone call to the number provided at registration.
  • In-Person. When participants are already on-site, in-person announcements may be made by program staff.

Participant Responsibilities. Participants are responsible for regularly checking their email, phone, and other communication channels for updates. They are also encouraged to ensure that all contact information provided during registration is accurate and up-to-date to avoid any missed communications.

7. RIGHT OF REFUSAL

Reservation of Rights. We reserve the right to refuse or terminate the participation of any individual or entity, including spectators, from our programs at any time, for any reason, within the bounds of applicable law. This includes, but is not limited to, situations where we assesses a participant's or spectator's behavior as incompatible with the program's values, safety, order, or community interests.

Conduct and Participation. We expect all participants, parents, guardians and spectators to adhere to a standard of behavior that reflects positively on the Showtime Flag community. This includes, but is not limited to, showing respect for all individuals, properties, and facilities associated with our programs. Failure to uphold these standards, as solely determined by us, may result in the denial of access or continuation in the program.

Notice of Denial or Revocation. Should a decision be made to deny or revoke participation, we will provide prompt communication to the affected party to the extent practicable. We are not obligated to disclose the reasoning behind the decision to refuse or terminate participation, although we may choose to do so at our discretion.

Appeals Process. In the event that participation is refused or revoked, the individual, or the parents and guardians in the case of a minor, may request a review of the decision by submitting a written appeal to our administration within seven (7) days of notification. The appeal must contain specific reasons why the decision should be reconsidered. The outcome of the appeals process is final and will be communicated to the individual in writing.

Non-discrimination. We are committed to providing an inclusive and welcoming environment for all participants. Any decision to deny or revoke participation will be made in compliance with applicable federal, state, and local anti-discrimination laws.

We reserve the right to modify the following sections at any time:

  • Eligibility Criteria
  • Refund Policy
  • Credit Policy
  • Program Changes
  • Right of Refusal

Any such changes will be posted to this page, and the "Last Updated" date at the top of this page will be revised accordingly.

Please note that notwithstanding any future changes, the waiver, as well as the photo and video release provisions, shall remain as initially agreed upon by the parent or guardian for the minor participant.

It is the responsibility of the parent or guardian to review these terms periodically. Continued participation of the minor in the program following any modifications to the specified sections constitutes the parent or guardian's acknowledgment and consent to the new terms as updated.
